Full Definition

A Section 125 plan (also called a cafeteria plan) is an employer-sponsored benefit plan that allows employees to pay for eligible benefits — health insurance premiums, FSA contributions, dependent care FSA contributions — with pre-tax dollars. Section 125 plans must be in writing, cannot discriminate in favor of highly compensated employees, and must pass annual nondiscrimination testing.
