Balance billing occurs when an out-of-network provider charges a patient the difference between the provider's billed charge and the amount the health plan paid. The No Surprises Act (effective 2022) prohibits balance billing for most emergency services and certain non-emergency services at in-network facilities. Balance billing is a significant risk for employers using reference-based pricing without robust member advocacy.
