The Health Insurance Portability and Accountability Act (HIPAA) establishes national standards for the protection of individually identifiable health information (PHI). For employer health plans, HIPAA requires a privacy notice, limits use and disclosure of PHI, and requires a business associate agreement with any vendor that handles PHI. HIPAA also includes portability provisions that limit pre-existing condition exclusions.
